Financial talk

i need advice on this one. please help me. I bought an item at ebay this last tuesday (april 15). it's a PS3 for 399usd with shipping. i made an instant payment to him so he could have the money the next day and be able to ship the item right away. 3 days had past.. i checked my mail on yahoo hoping he will post something there to keep me updated about the item. so i got a mail from him on april 18 asking why it is an un confirmed address? and if i could fax a copy of my driver license for identification to him ..? i rplied to him saying " it's okay, i'm real. and that i don't have fax machine" and the fact that i don't want to fax my driver license. after that he didn't reply back to me. so another day pasts by. i mailed him asking what happened to the item and when will he gonna ship it. he replied to me "What item?". i replied back saying " THE PS3". then he reply back again saying "there was a delay on shipping because my address is un confirmed. he's ship guys were just waiting for ok on him and he is waiting for his document. then i replied back saying " when will you ship the item?" he replied " i can ship the item right away, i lost 1500 usd on a laptop because of fraud payment." this is when i made a decision and file a non-recieve dispute in paypal because he wasn't giving me helpful info. and so he can't get away with my money. the next day i (today) i asked him again about the shipping. he replied saying he will ship the item on monday if i cancel chargeback. so i told him i'll cancel it when i recieve the item. it's like he can't ship the item to an unconfirmed address because he thinks i'll get away with his item. as for me i'm thinking like him that he will get away with my money. so right now he said his account on paypal is froze and if i cancel the dispute then he can ship it. i told him the fairest way it to refund me after that im gonna make my address a confirmed one so nothing would go wrong. if he insist on refunding me then im going to call my bank and issue a chargeback. so guys what do you think i should do? i can't let him run away with my money. im still going to get my money even he won't give refund? thank you
